OS DIREITOS HUMANOS E FUNDAMENTAIS NAS RELAÇÕES DE TRABALHO SOB A ÓTICA DA TEORIA CRÍTICA

Resumo

O tema aqui apresentado refere-se à compreensão dos direitos humanos nas relações do trabalho sob à ótica do direito contemporâneo. Investiga a relação entre o sistema laboral e sua práxis, mediado por uma justa realização no campo das relações laborais. O direito longe de ser reduzido à aplicação de leis e códigos deve ser compreendido campo de manifestação dos conflitos entre os homens, no resgate de seus direitos, tendo como parâmetro a justiça. A pesquisa tem como opção teórico-metodlógica uma abordagem crítica do direito, elegendo como método de procedimento um estudo histórico e comparativo. Conclui-se que o direito do trabalho, em sua feição individual, e, sobretudo, na dimensão coletiva teve constituiu-se como fruto, tendo dessa forma o primado como consumação das lutas sociais ao longo da odisséia dostrabalhadores no mundo do reino do poder do capital.FUNDAMENTAL HUMAN RIGHTS AND IN THE WORKPLACE FROM THE PERSPECTIVE OF CRITICAL THEORYThe issue presented here refers to the understanding of human rights in labor relations from the perspective of modern law.
