MORALISMO, POSITIVISMO E O ESTADO BRASILEIRO

Resumo

O presente artigo tem como objetivo elucidar características básicas da formação do Estado do nosso país, como o positivismo, a democracia, o conceito de moral e justiça, e confrontá-los com a realidade, demonstrando as incoerências e provando a distância do Estado e sua população. Para tal, serão explicados conceitos chave de vários assuntos propedêuticos do Curso de Direito, e posteriormente, através de metodologia dedutiva, confrontados com fatos contemporâneos e de interesse geral da sociedade, como por exemplo, se a moral deve ou não ser levada emconsideração no sistema jurídico. Por fim, discute que para um melhor funcionamento do Estado, faz-se necessária a presença maior do povo, através não apenas de seus representantes diretos, os políticos, mas também através de órgãos legitimados que defendam seus interesses.REGULATORY AGENCIES IN THE NATIONAL LAWAbstract: This article aims to elucidate the basic characteristics that form the State of our country, such as positivism, democracy. The concept of morality and justice, confronting them with the reality, demonstrating the inconsistencies and proving the distance between the State and its population. For such, some key concepts in various subjects that are propaedeutic to law school will be explained and then,by deductive methodology, they'll be confronted with contemporary events and events of general interest of society, such as whether or not morality must be taken into account in legal system. Finally, it argues that to better functioning of the State, it is necessary to enhance the presence of the people, not only through its direct representatives, the politicians, but also by the legitimated organisms that will defend the interests of them.Keywords: Morality.
